Sicura Terms of Use

Welcome to Sicura, a personalized health protector developed by Sicura Health Pty Ltd ("Sicura", "we", "us", or "our"). These Terms of Use ("Terms") govern your access to and use of the Sicura mobile application and services (collectively, the "App"). By downloading or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old to use Sicura. By using the App, you confirm that you meet this requirement.

2. What Sicura Does

Sicura provides personalized health insights based on data drawn from your health record. It connects to authorized Health Data Sources (e.g., Apple Health, CommonHealth), along with any manually entered data or other data available on your mobile device.

Sicura is a general wellness tool. It is not intended for medical use, including monitoring, diagnosis, or treatment of health conditions. It is not a medical device and should not be relied upon for medical decisions. Sicura does not substitute for medical advice from a qualified healthcare provider. Use of Sicura does not create a provider-patient relationship. It offers general information only, which should not be treated as medical guidance. Always consult a licensed healthcare provider for medical decisions.

3. Your Agreement and Consent

By using the App, you consent to:

  • The collection of health-related data from your authorized Health Data Sources

  • The use of your health data to provide insights as outlined in the App

  • The handling of data in accordance with our [Privacy Policy]

You may revoke your consent at any time by deleting the App.

4. Your Responsibilities

You agree to use Sicura only for personal, lawful, non-commercial purposes. You must not:

• Reverse-engineer, tamper with, or interfere with the App

• Upload harmful code or content

• Impersonate others or provide false health data

You are responsible for any activity conducted via your account or mobile device.

5. Account and Security

If the App requires login credentials, you must keep them secure. You are solely responsible for access to your health data through your device.

We are not liable for unauthorized access that results from compromised device security, including unauthorized device modifications ("jailbreaking" or "rooting").

6. Data Storage and Privacy

Most health data remains on your device. Sicura collects only minimal data in the cloud, such as:

• Anonymized error logs

• Unrecognized lab codes or ranges (no values)

• User identifiers for account management

• Aggregated, non-identifiable usage statistics

If you choose to back up your device (e.g., to iCloud or a local computer), your health data may be included in that backup, and we recommend securing your backup accordingly.

7. Information Accuracy and Limitations

The health information shown in the App may include:

• Historical data from your Health Data Sources

• Your manually entered goals or notes

• General health education material

While we strive for accuracy, Sicura cannot guarantee that all content is current, correct, or suitable for your condition.

The information is provided "as is", without warranties of any kind. You should always verify health issues with a healthcare professional.

8. Engagement Tools

Sicura may allow you to connect with third party providers and intelligent software agents that may provide services to address your health needs.

If you choose to connect to such providers (e.g., for a coaching service or clinic), that party may infer certain health information about you. Before proceeding, Sicura will display a clear disclosure notice.

9. Links to Third Parties

Sicura may link to external websites or services (e.g., provider booking tools). These are for your convenience only. We are not responsible for their privacy practices, accuracy, or availability.

10. Intellectual Property

All intellectual property in the App, including logos, graphics, algorithms, and health rule sets, belongs to Sicura Health, Inc. or its licensors. You may not copy or use them without permission.

11. Changes to the App or Terms

We may update the App or these Terms at any time. If changes are significant, you’ll be prompted to review and accept them upon next use. Continued use of the App means you accept the revised Terms.

12. Termination

You may stop using Sicura at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the service.

When your access ends, Sicura will stop updating your health record, but your stored data will remain accessible on your device unless you delete the App.

13. Limitation of Liability

To the maximum extent permitted by law, Sicura Health is not liable for:

• Medical decisions made using information from the App

• Errors in data from your Health Data Sources

• Damage from unauthorized access to your device

• Loss of data due to device loss, reset, or deletion

If required by consumer protection law, our liability is limited to re-supplying the service or refunding the cost of the service.

Sicura is not intended for medical use, including diagnosis or treatment of health conditions. All health-related decisions should be made in consultation with a qualified medical professional. It is not a medical device and should not be relied upon for medical decisions. Always consult a qualified healthcare provider with any questions regarding a medical condition or your health.

14. Governing Law

These Terms shall be governed by and interpreted under the laws of the State of California, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts in California.

If you are dissatisfied with the App, your sole remedy is to discontinue use.

By using Sicura, you acknowledge that you have read, understood, and agreed to these Terms.

16. Dispute Resolution

In the event of any dispute arising out of or relating to these Terms or your use of the App, both parties agree to first attempt resolution through informal negotiation. If unresolved, disputes will be resolved by binding arbitration in California, unless prohibited by law. You waive the right to a jury trial or to participate in a class action.
